Do I need a building permit?

  • Residential Customers may contact the Residential Technical Answer Center, or RTAC, to determine if a building permit is needed at 704-432-7822 or click here for the RTAC website.

    If it is determined that you need a permit: if your property is located in a subdivision (with the exception of Biltmore Park) then you will need to obtain your permit through Mecklenburg County. You may contact them at 704-336-3569. If your property is not located in a subdivision, or located in the Biltmore Park subdivision, then you will need to first obtain zoning approval at the Town of Huntersville Planning Department. Do I need a building permit to put up a shed?

If any of the sheds dimensions are 12 feet or greater, then a Buidling Permit will be required. If the dimensions of the shed are less than 12 feet then you will need a Zoning Permit. Both of these permits are available at the Town of Huntersville Planning Department or you can access them online. Click here for permit applications that you can download. Do I need a building permit to construct a deck?

You will need a building permit to construct a deck since it is a load bearing structure. You can obtain a building permit at the Town of Huntersville Planning Department or you can access them online. Click here for permit applications that you can download. If your property is located in a subdivision (with the exception of Biltmore Park) then you will need to obtain your permit through Mecklenburg County. You may contact them at 704-336-3569. What is the residential permitting process?

  • Property located within a subdivision- If your property is located in a subdivision (with the exception of the Biltmore Park Subdivision) any permits can be obtained by the property owner or owner's agent from the Engineering & Building Standards Department located at 700 North Tryon Street, Charlotte, N. C. (704-336-3803) The department's operating hours are Monday - Friday, from 8:00 a.m. to 5:00 p.m. Applications for electrical, mechanical, and plumbing permits may be mailed.  Contractors with an established account may submit residential permits and commercial permits for small jobs from their website. The Mecklenburg County North Office, or LUESA (Land Use and Environmental Services Agency) also issues building permits. They are located at 18335 Old Statesville Road, Suite K, Cornelius NC 28031 and their number is 704-432-2520.
  • Property not located in a subdivision - If your property is not located in a subdivision, or it is located in the Biltmore Park Subdivision, then you will need to obtain zoning approval on your building permit application from the Huntersville Planning Department prior to submitting the building permit to Mecklenburg County. Huntersville Zoning Approval will be processed in the order recieved, and should be no longer than a few days.

What is the commercial permitting process?

For questions about obtaining a commercial permit, you need to contact the Town of Huntersville Planning Department at 704-875-7000 and ask to speak with a commercial planner.

You may contact the Mecklenburg County Commercial Technical Anser Center (CTAC) at 704-336-3829 for questions regarding commercial building codes.

What is my property zoned?

To find out what your property is zoned you can go to the Mecklenburg County POLARIS website:http://polaris.mecklenburgcountync.gov/website/redesign/viewer.htm. Click on "Search", then you can enter an address or parcel number of the property you want to find the zoning of. A list of matching properties will be displayed. Click on the parcel number for the property and a map will be brought up. Click on "layers" and then check the box "Zoning-towns" and refresh the map. The zoning of the property will then be displayed. To find the requirements in a certain zoning district you can access an interactive Huntersville Zoning Ordinance at http://www.huntersville.org/Interactive%20Ordinance.htm.

What are my setbacks?

Due to variable setbacks within the Town of Huntersville, it is best to contact Planning Staff at 704-875-7000 to verify the setbacks on your property.

What does impervious mean?

Impervious ground cover is any structure or ground cover consisting of asphalt, concrete, stone, brick,terrazzo, roofing, ceramic tile or any other natural or man-made material that prevents the absorption of surface water into the soil.

Further, Built-upon Area (B.U.) shall include that portion of a development project and/or lots that are covered by impervious or partially impervious cover including buildings, pavement, gravel areas (e.g. roads, parking lots, paths), recreation facilities (e.g. tennis courts), etc. (NOTE: Wooden slatted decks and the water area of a swimming pool are considered pervious.)


Does my property have impervious restrictions?

Most of the properties in Huntersville located on the west side of I-77, and some properties to the east side of I-77 are located in a watershed overlay district and have impervious restrictions. To find out if there are impervious restrictions on your property, contact Planning Staff at 704-875-7000.

Who can I contact about the minimum housing code?

For minimum housing issues located within the Town of Huntersville corporate limits contact Renee Willson, Code Enforcement Officer, at 704-875-7000. For minimum housing issues located outside the Town of Huntersville corporate limits, in the extraterritorial jourisdiction, contact Ron Featherstone with Mecklenburg County at 704-432-2529. If you are unsure if the property is located in the Town corporate limits, you may contact the Huntersville Planning Department at 704-875-7000 and a staff member will be happy to assist you.


Do I need a business license?

The Town of Huntersville does not require business licenses. You should obtain a business license from the Mecklenburg County Business Tax Collections Department at 704-336-6315.


Can i operate a business from my home?

The Huntersville Zoning Ordinance has a provision for residents to operate a business from their home with the following conditions found in Article 9:

A home occupation is permitted accessory to any dwelling unit (except manufactured housing) in accordance with the following requirements:


.1 The home occupation must be clearly incidental to the residential use of the dwelling and must not change the essential residential character of the dwelling.
.2 A home occupation conducted in an accessory structure shall be housed only in a garage or other accessory structure typically associated with a dwelling.
.3 The use shall employ no more than one person who is not a resident of the dwelling.
.4 A home occupation housed within the dwelling shall occupy no more than 25 percent of the total floor area of the dwelling.
.5 There shall be no visible outside display of stock in trade which is sold on the premises.
.6 There shall be no outdoor storage or visible evidence of equipment or materials used in the home occupation, excepting equipment or materials of a type and quantity that could reasonably be associated with the principal residential use.
.7 Operation of the home occupation shall not be visible from any dwelling on an adjacent lot, nor from a street.
.8 Only vehicles used primarily as passenger vehicles will be permitted in connection with the conduct of the home occupation.
.9 The home occupation shall not utilize mechanical, electrical, or other equipment which produces noise, electrical or magnetic interference, vibration, heat, glare, or other nuisances outside the dwelling or accessory structure housing the home occupation.
.10 Home occupations shall be limited to those uses which do not draw clients to the dwelling on a regular basis.
.11 Outdoor kilns used for the firing of pottery shall be provided with a semi-opaque screen to obstruct the view from the street and from adjacent properties located in residential districts, shall have a secured work area, and shall be a minimum of 10 feet from abutting property lines.
.12 No business identification or advertising signs are permitted.
